About banks not paying the fines for their crimes but society paying instead
Those who have to be penalized are the board members that establish the incentives and internal processes which prompt the irresponsible behavior. And if the incentives and processes lead to responsibility, those who have to be penalized are the employees who violate these processes. And if there are groups of shareholders who own a large part of the banks and have the power to choose the managers and influence decisions, then these have to be punished as well. And if the members of Ethics, Risk or Compliance Committees do not do their jobs, then they also have to be penalized. This way there would be a correlation between irresponsibility and punishment, unlike now that employees and managers take the bonds and society pays the fine. Benefits are privatized and costs are socialized.
